Ky ligj, i harmonizuar me\u00a0<strong>Rregulloren e P\u00ebrgjithshme p\u00ebr Mbrojtjen e t\u00eb Dh\u00ebnave (GDPR \u2013 BE 679\/2016)<\/strong>, vendos k\u00ebrkesa t\u00eb reja p\u00ebr t\u00eb gjitha subjektet q\u00eb p\u00ebrpunojn\u00eb t\u00eb dh\u00ebna personale, duke p\u00ebrfshir\u00eb bizneset private dhe institucionet publike. P\u00ebr t\u00eb kuptuar m\u00eb shum\u00eb rreth k\u00ebtyre, ne kemi zhviluar nj\u00eb intervst\u00eb me Denisa Dedej, avokate.<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li aria-level=\"1\"><b>\u00c7far\u00eb \u00ebsht\u00eb GDPR dhe cilat jan\u00eb detyrimet q\u00eb lindin prej saj?<\/b><\/li>\n<\/ul>\n<p><b>GDPR<\/b>\u00a0(Rregullorja e P\u00ebrgjithshme p\u00ebr Mbrojtjen e t\u00eb Dh\u00ebnave\u00a0<b>\u2013 BE 2016\/679<\/b>) \u00ebsht\u00eb ligji kryesor i BE-s\u00eb p\u00ebr mbrojtjen e t\u00eb dh\u00ebnave personale dhe zbatohet p\u00ebr t\u00eb gjitha organizatat q\u00eb p\u00ebrpunojn\u00eb t\u00eb dh\u00ebna t\u00eb individ\u00ebve brenda BE-s\u00eb, ose q\u00eb ofrojn\u00eb sh\u00ebrbime p\u00ebr individ\u00eb brenda BE-s\u00eb, pavar\u00ebsisht se ku ndodhen ata.<\/p>\n<div>\n<div class=\"ads desktop d-none d-lg-block\"><ins id=\"revive-2-4\" data-revive-zoneid=\"23\" data-revive-id=\"0e4b1b2070750b835d82265ea35e4e68\" data-revive-seq=\"4\" data-revive-loaded=\"1\"><\/p>\n<div id=\"beacon_e0ce3da32a\"><img decoding=\"async\" src=\"https:\/\/ads.nmc.al\/www\/delivery\/lg.php?bannerid=46&amp;campaignid=1&amp;zoneid=23&amp;loc=https%3A%2F%2Fbusinessmag.al%2Fligji-i-ri-per-mbrojtjen-e-te-dhenave-personale-avokatja-denisa-dedej-na-tregon-gjithcka-qe-duhet-te-kemi-parasysh%2F&amp;cb=e0ce3da32a\" alt=\"\" width=\"0\" height=\"0\" \/><\/div>\n<p><\/ins><\/div>\n<\/div>\n<p>Detyrimet kryesore t\u00eb GDPR<\/p>\n<ul>\n<li aria-level=\"1\">\u00a0<b>P\u00ebrpunimi i t\u00eb dh\u00ebnave me p\u00ebrgjegj\u00ebsi<\/b>\u00a0\u2013 t\u00eb dh\u00ebnat duhet t\u00eb p\u00ebrpunohen n\u00eb m\u00ebnyr\u00eb t\u00eb ligjshme, transparente dhe vet\u00ebm p\u00ebr q\u00ebllime t\u00eb qarta. Duhet t\u00eb mblidhet vet\u00ebm informacioni i nevojsh\u00ebm, t\u00eb jet\u00eb i sakt\u00eb dhe t\u00eb ruhet i sigurt.<\/li>\n<li aria-level=\"1\">\u00a0<b>Bazat ligjore p\u00ebr p\u00ebrpunimin<\/b>\u00a0\u2013 t\u00eb dh\u00ebnat mund t\u00eb p\u00ebrpunohen vet\u00ebm n\u00ebse ka nj\u00eb arsye t\u00eb vlefshme, si:\u00a0P\u00eblqimi i personit; Detyrimi ligjor ;\u00a0 Kontrata (p.sh., t\u00eb dh\u00ebnat e klient\u00ebve p\u00ebr nj\u00eb sh\u00ebrbim); Interesi publik ose legjitim (p.sh., masat e siguris\u00eb n\u00eb nj\u00eb kompani)<\/li>\n<li aria-level=\"1\"><b>T\u00eb drejtat e individ\u00ebve<\/b>\u00a0\u2013 \u00e7do person ka t\u00eb drejt\u00eb t\u00eb: K\u00ebrkoj\u00eb informacion mbi t\u00eb dh\u00ebnat e tij;\u00a0 Korrigjoj\u00eb t\u00eb dh\u00ebnat e pasakta; K\u00ebrkoj\u00eb fshirjen e t\u00eb dh\u00ebnave t\u00eb tij; Transferoj\u00eb t\u00eb dh\u00ebnat te nj\u00eb pal\u00eb tjet\u00ebr; Kund\u00ebrshtoj\u00eb p\u00ebrpunimin e t\u00eb dh\u00ebnave p\u00ebr q\u00ebllime t\u00eb caktuara<\/li>\n<li aria-level=\"1\"><b>Transparenca<\/b>\u00a0\u2013 individ\u00ebt duhet t\u00eb informohen qart\u00eb dhe n\u00eb m\u00ebnyr\u00eb t\u00eb kuptueshme se si p\u00ebrdoren t\u00eb dh\u00ebnat e tyre.<\/li>\n<li aria-level=\"1\">\u00a0<b>Siguria<\/b>\u00a0\u2013 bizneset dhe organizatat duhet t\u00eb marrin masa p\u00ebr t\u00eb mbrojtur t\u00eb dh\u00ebnat nga humbja, vjedhja apo keqp\u00ebrdorimi dhe t\u00eb njoftojn\u00eb autoritetet brenda\u00a0<b>72 or\u00ebve<\/b>\u00a0n\u00eb rast t\u00eb nj\u00eb shkeljeje t\u00eb siguris\u00eb.<\/li>\n<li aria-level=\"1\">\u00a0<b>Em\u00ebrimi i nj\u00eb DPO (Oficer p\u00ebr Mbrojtjen e t\u00eb Dh\u00ebnave)<\/b>\u00a0\u2013 disa organizata, sidomos ato q\u00eb p\u00ebrpunojn\u00eb shum\u00eb t\u00eb dh\u00ebna personale, duhet t\u00eb caktojn\u00eb nj\u00eb ekspert p\u00ebr t\u00eb mbik\u00ebqyrur pajtueshm\u00ebrin\u00eb me GDPR.<\/li>\n<li aria-level=\"1\">\u00a0<b>Transferimi i t\u00eb dh\u00ebnave jasht\u00eb BE-s\u00eb<\/b>\u00a0\u2013 ndalohet p\u00ebrve\u00e7 n\u00ebse vendi i marr\u00ebsit ka masa t\u00eb mjaftueshme mbrojtjeje.<\/li>\n<li aria-level=\"1\">\u00a0<b>Gjobat dhe sanksionet<\/b>\u00a0\u2013 shkeljet e GDPR mund t\u00eb nd\u00ebshkohen me gjoba deri n\u00eb\u00a0<b>20 milion\u00eb euro ose 4% t\u00eb t\u00eb ardhurave vjetore globale<\/b>\u00a0t\u00eb kompanis\u00eb.<\/li>\n<\/ul>\n<div><\/div>\n<p><b>2.Ekonomia shqiptare n\u00eb shum\u00eb drejtime po punon q\u00eb ta p\u00ebrafrohet me normativa t\u00eb BE-s\u00eb, n\u00eb kuad\u00ebr t\u00eb procesit t\u00eb integrimit t\u00eb vendit n\u00eb Union. A n\u00ebnkupton kjo q\u00eb duhet t\u00eb ket\u00eb ndyshime edhe n\u00eb p\u00ebrshtatjen e ligjit p\u00ebr Mbrojtjen e t\u00eb Dh\u00ebnave?<\/b><\/p>\n<p>Ligji nr. 124\/2024 p\u00ebr mbrojtjen e t\u00eb dh\u00ebnave personale ka hyr\u00eb n\u00eb fuqi n\u00eb shkurt 2025 dhe p\u00ebrfaq\u00ebson nj\u00eb hap t\u00eb r\u00ebnd\u00ebsish\u00ebm p\u00ebr p\u00ebrafrimin e legjislacionit shqiptar me rregullat e Gdpr t\u00eb Bashkimit Europian.<\/p>\n<p>Ky ligj sjell rritje t\u00eb mbrojtjes s\u00eb t\u00eb dh\u00ebnave personale, duke forcuar t\u00eb drejtat e individ\u00ebve dhe duke rritur p\u00ebrgjegj\u00ebsit\u00eb p\u00ebr organizatat q\u00eb p\u00ebrpunojn\u00eb t\u00eb dh\u00ebna. Ai p\u00ebrfshin detyrime m\u00eb t\u00eb rrepta p\u00ebr sigurin\u00eb e t\u00eb dh\u00ebnave dhe p\u00ebrputhshm\u00ebrin\u00eb me standardet nd\u00ebrkomb\u00ebtare, duke i dh\u00ebn\u00eb Shqip\u00ebris\u00eb mund\u00ebsin\u00eb t\u00eb p\u00ebrmbush\u00eb k\u00ebrkesat e BE-s\u00eb dhe t\u00eb mund\u00ebsoj\u00eb transferimin e t\u00eb dh\u00ebnave n\u00eb nj\u00eb mjedis t\u00eb sigurt nd\u00ebrkomb\u00ebtar.<\/p>\n<p><b>3.N\u00ebse po, cilat jan\u00eb hapat e ardhsh\u00ebm q\u00eb duhet t\u00eb nd\u00ebrrmerren?<\/b><\/p>\n<p>Pas hyrjes n\u00eb fuqi t\u00eb\u00a0<b>Ligjit nr. 124\/2024<\/b>\u00a0p\u00ebr mbrojtjen e t\u00eb dh\u00ebnave personale, disa hapa t\u00eb r\u00ebnd\u00ebsish\u00ebm duhet t\u00eb nd\u00ebrmerren p\u00ebr t\u00eb siguruar p\u00ebrputhshm\u00ebrin\u00eb dhe zbatimin e tij efektiv. Ja disa nga hapat ky\u00e7:<\/p>\n<ul>\n<li aria-level=\"1\"><b>P\u00ebrdit\u00ebsimi i politikave dhe procedurave t\u00eb brendshme<\/b>: Organizatat duhet t\u00eb rivler\u00ebsojn\u00eb dhe p\u00ebrdit\u00ebsojn\u00eb politikat dhe procedurat e tyre t\u00eb mbrojtjes s\u00eb t\u00eb dh\u00ebnave p\u00ebr t\u2019u p\u00ebrputhur me k\u00ebrkesat e ligjit t\u00eb ri. Kjo mund t\u00eb p\u00ebrfshij\u00eb krijimin e procedurave p\u00ebr mbledhjen, p\u00ebrpunimin, ruajtjen dhe fshirjen e t\u00eb dh\u00ebnave personale.<\/li>\n<li aria-level=\"1\"><b>Trajnimi i stafit<\/b>: \u00cbsht\u00eb e r\u00ebnd\u00ebsishme q\u00eb t\u00eb gjith\u00eb punonj\u00ebsit, p\u00ebrfshir\u00eb menaxher\u00ebt dhe drejtor\u00ebt, t\u00eb jen\u00eb t\u00eb trajnuar p\u00ebr t\u00eb kuptuar dhe zbatuar detyrimet e ligjit. Kjo mund t\u00eb p\u00ebrfshij\u00eb trajnim n\u00eb lidhje me t\u00eb drejtat e individ\u00ebve, proceset e k\u00ebrkesave p\u00ebr t\u00eb dh\u00ebna dhe m\u00ebnyr\u00ebn e menaxhimit t\u00eb shkeljeve t\u00eb mundshme.<\/li>\n<li aria-level=\"1\"><b>Em\u00ebrimi i nj\u00eb DPO (Oficer p\u00ebr Mbrojtjen e t\u00eb Dh\u00ebnave)<\/b>: Organizatat q\u00eb p\u00ebrpunojn\u00eb t\u00eb dh\u00ebna n\u00eb mas\u00eb t\u00eb madhe, ose q\u00eb kan\u00eb aktivitete q\u00eb k\u00ebrkojn\u00eb mbrojtjen e t\u00eb dh\u00ebnave t\u00eb ndjeshme, duhet t\u00eb em\u00ebrojn\u00eb nj\u00eb Oficer p\u00ebr Mbrojtjen e t\u00eb Dh\u00ebnave (DPO), i cili do t\u00eb ket\u00eb p\u00ebrgjegj\u00ebsin\u00eb p\u00ebr monitorimin e zbatimit t\u00eb ligjit dhe k\u00ebshillimin e organizat\u00ebs n\u00eb lidhje me praktikat e mbrojtjes s\u00eb t\u00eb dh\u00ebnave<b>.\u00a0<\/b>(Bizneset q\u00eb ofrojn\u00eb sh\u00ebrbime financiare, banka, sigurime, spitalet, kompani q\u00eb merren me informacionin sh\u00ebndet\u00ebsor, kompani q\u00eb p\u00ebrpunojn\u00eb t\u00eb dh\u00ebna personale t\u00eb shum\u00eb individ\u00ebve si\u00e7 jan\u00eb platformat e marketingut digjital, kompanit\u00eb q\u00eb menaxhojn\u00eb t\u00eb dh\u00ebnat e punonj\u00ebsve, etj.)<\/li>\n<li aria-level=\"1\"><b>Rishikimi i marr\u00ebveshjeve me pal\u00eb t\u00eb treta<\/b>: \u00c7do kontrat\u00eb q\u00eb p\u00ebrfshin ndarjen e t\u00eb dh\u00ebnave me pal\u00eb t\u00eb treta duhet t\u00eb rishikohet dhe p\u00ebrdit\u00ebsohet p\u00ebr t\u00eb siguruar q\u00eb k\u00ebto pal\u00eb respektojn\u00eb gjithashtu standardet e mbrojtjes s\u00eb t\u00eb dh\u00ebnave, duke p\u00ebrfshir\u00eb marr\u00ebveshjet p\u00ebr p\u00ebrpunimin e t\u00eb dh\u00ebnave.<\/li>\n<li aria-level=\"1\"><b>Krijimi i nj\u00eb procedure p\u00ebr raportimin e shkeljeve<\/b>: Ligji k\u00ebrkon q\u00eb shkeljet e t\u00eb dh\u00ebnave t\u00eb raportohen brenda 72 or\u00ebve. Kjo do t\u00eb k\u00ebrkoj\u00eb krijimin e nj\u00eb procedure t\u00eb qart\u00eb dhe efikase p\u00ebr t\u00eb identifikuar, regjistruar dhe raportuar \u00e7do incident t\u00eb mundsh\u00ebm t\u00eb siguris\u00eb q\u00eb ndikon n\u00eb t\u00eb dh\u00ebnat personale.<\/li>\n<li aria-level=\"1\"><b>Monitorimi dhe mbik\u00ebqyrja e vazhdueshme<\/b>: Pas zbatimit t\u00eb ligjit, \u00ebsht\u00eb e r\u00ebnd\u00ebsishme t\u00eb monitorohen vazhdimisht praktikat e p\u00ebrpunimit t\u00eb t\u00eb dh\u00ebnave dhe t\u00eb merren masa parandaluese n\u00ebse identifikohen rreziqe t\u00eb mundshme p\u00ebr mbrojtjen e t\u00eb dh\u00ebnave personale.<\/li>\n<\/ul>\n<p><b><\/b><b>4.\u00c7far\u00eb duhet t\u00eb ket\u00eb parasysh sot nj\u00eb biznes q\u00eb ruan t\u00eb dh\u00ebnat e klient\u00ebve, p\u00ebrdoruesve n\u00eb nj\u00eb database, q\u00eb nga adresa e email-it deri tek gjurm\u00ebt e pagesave online? \u00c7far\u00eb masash duhet t\u00eb nd\u00ebrmarr q\u00eb t\u00eb jet\u00eb ligj\u00ebrisht \u2018 mbrojtur\u2019?\u00a0<\/b><\/p>\n<p>Nj\u00eb biznes q\u00eb ruan t\u00eb dh\u00ebnat e klient\u00ebve duhet t\u00eb nd\u00ebrmarr\u00eb masat e m\u00ebposhtme p\u00ebr t\u00eb qen\u00eb n\u00eb p\u00ebrputhje me Ligjin p\u00ebr mbrojtjen e t\u00eb dh\u00ebnave dhe GDPR:<\/p>\n<ul>\n<li aria-level=\"1\"><b>Siguria teknike<\/b>: Kriptimi i t\u00eb dh\u00ebnave, p\u00ebrdorimi i firewall-it dhe menaxhimi i aksesit t\u00eb sigurt p\u00ebr t\u00eb parandaluar hyrjen e paautorizuar.<\/li>\n<li aria-level=\"1\"><b>P\u00eblqimi dhe transparenca<\/b>: Sigurimi i p\u00eblqimit t\u00eb qart\u00eb t\u00eb p\u00ebrdoruesve p\u00ebr mblidhjen dhe p\u00ebrdorimin e t\u00eb dh\u00ebnave, dhe informimi p\u00ebr m\u00ebnyr\u00ebn e p\u00ebrpunimit.<\/li>\n<li aria-level=\"1\"><b>Ruajtja dhe fshirja e t\u00eb dh\u00ebnave<\/b>: T\u00eb dh\u00ebnat duhet t\u00eb ruhen p\u00ebr aq koh\u00eb sa \u00ebsht\u00eb e nevojshme dhe t\u00eb fshihen pas k\u00ebsaj periudhe.<\/li>\n<li aria-level=\"1\"><b>Trajnimi i stafit<\/b>: Edukimi i punonj\u00ebsve mbi praktikat e mbrojtjes s\u00eb t\u00eb dh\u00ebnave dhe GDPR.<\/li>\n<li aria-level=\"1\"><b>Menaxhimi i shkeljeve t\u00eb t\u00eb dh\u00ebnave<\/b>: Krijimi i nj\u00eb procedure p\u00ebr raportimin e shkeljeve dhe veprimeve pas tyre brenda 72 or\u00ebve.<\/li>\n<li aria-level=\"1\"><b>Transferimi i t\u00eb dh\u00ebnave<\/b>: Sigurimi q\u00eb \u00e7do transferim t\u00eb dh\u00ebnash jasht\u00eb vendit t\u00eb b\u00ebhet n\u00eb p\u00ebrputhje me k\u00ebrkesat e ligjit.<\/li>\n<li aria-level=\"1\"><b>DPO (Oficer p\u00ebr Mbrojtjen e t\u00eb Dh\u00ebnave)<\/b>: N\u00ebse \u00ebsht\u00eb e nevojshme, em\u00ebrimi i nj\u00eb DPO p\u00ebr t\u00eb mbik\u00ebqyrur p\u00ebrputhshm\u00ebrin\u00eb me ligjin dhe ofruar k\u00ebshilla p\u00ebr praktikat e mbrojtjes s\u00eb t\u00eb dh\u00ebnave.<\/li>\n<\/ul>\n<p><b><br \/>\n<\/b><b>5.A jan\u00eb bizneset shqiptare mjaftuesh\u00ebm t\u00eb informuar p\u00ebr GDPR? Cilat jan\u00eb sfidat q\u00eb ju hasni n\u00eb p\u00ebrditshm\u00ebri n\u00eb k\u00ebt\u00eb drejtim ?<\/b><\/p>\n<p>Koh\u00ebt e fundit, bizneset shqiptare kan\u00eb filluar t\u00eb kuptojn\u00eb r\u00ebnd\u00ebsin\u00eb e\u00a0<b>GDPR<\/b>, por ende nuk jan\u00eb mjaftuesh\u00ebm t\u00eb informuara dhe t\u00eb p\u00ebrgatitura p\u00ebr ta zbatuar plot\u00ebsisht ligjin. Sidomos, bizneset q\u00eb vijn\u00eb nga jasht\u00eb jan\u00eb m\u00eb t\u00eb njohura me k\u00ebrkesat e ligjit, pasi ata shpesh jan\u00eb t\u00eb detyruar t\u00eb zbatojn\u00eb\u00a0<b>GDPR<\/b>\u00a0n\u00eb shtetet e tyre t\u00eb origjin\u00ebs.<\/p>\n<p>Nga ana tjet\u00ebr, shum\u00eb banka dhe institucione financiare jan\u00eb tashm\u00eb n\u00eb p\u00ebrputhshm\u00ebri me ligjin, duke u siguruar q\u00eb praktikat e tyre t\u00eb p\u00ebrputhen me standardet nd\u00ebrkomb\u00ebtare t\u00eb mbrojtjes s\u00eb t\u00eb dh\u00ebnave.
